Terms of Service

The terms you agree to when you create an account with NAKA.

These Terms govern your use of nakenyans.org and the NAKA mobile app, operated by NAKA. By creating an account you agree to them, to the Community Guidelines, and to the Privacy Policy.

1. Who can join

Membership is open to Kenyans in the diaspora — people of Kenyan origin or heritage living outside Kenya. You must be at least 18 years old.

We may review or decline a registration that appears not to meet this, including where a sign-up appears to originate in Kenya. Where that happens the account is reviewed by a person, not blocked automatically, and you may contact us if you believe a decision was wrong.

2. Your account

  • Provide accurate information and keep it current.
  • Use your real name. This is a professional association and members are accountable for what they post.
  • You are responsible for your password and for activity on your account.
  • One account per person. Do not impersonate anyone or misrepresent an affiliation.
  • Tell us promptly if you think someone else has access to your account.

3. Membership and dues

Free membership costs nothing. Premium is $50 per year. Campus is free with a verified .edu address.

Membership runs for twelve months from the date dues are paid, and renews on that anniversary. Dues are the same amount whenever you join and are never prorated.

  • Renewal is automatic unless you cancel before the renewal date. You can cancel any time from your profile.
  • Dues are non-refundable, including if you cancel mid-term or your account is suspended for breaching these Terms.
  • If a payment fails, membership enters a grace period and we will email you. If it is not resolved, membership reverts to Free — your account and content remain.
  • Dues may change with sixty days' notice, per the bylaws.

Campus requires an academic email that is verified, and re-verified annually. If it is not re-verified, membership reverts to Free.

Dues are not a charitable donation. NAKA is a 501(c)(6) professional association, not a 501(c)(3) charity. Dues may be deductible as an ordinary business expense where the membership relates to your trade or business, but they are not deductible as a charitable contribution. We cannot give tax advice — ask your own adviser.

4. What you post

You keep ownership of what you post. You grant NAKA a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it on the platform and in association communications, for as long as you keep it posted. You confirm you have the right to post it and that it does not infringe anyone else's rights.

We may remove content or restrict accounts that breach these Terms or the Community Guidelines. Content is normally archived rather than deleted, so a decision can be reversed. Appeals go to support@nakenyans.org.

5. Member conduct

The Community Guidelines form part of these Terms. In particular you agree not to attack or demean any Kenyan community or ethnic group, harass other members, run scams, or share another member's personal information — including their immigration status.

6. Directory, messaging, and member data

Access to the member directory and messaging is a benefit of Premium and Campus membership, provided for members to connect with each other. You agree not to:

  • Scrape, copy, or export the directory, in whole or in part
  • Use member contact details for bulk marketing, recruitment, or any purpose the member did not agree to
  • Pass member information to anyone outside NAKA

Breaching this is grounds for immediate removal, and is one of the few things we act on without warning.

7. Listings, events, and businesses

You are responsible for what you post being accurate and genuinely offered. We review submissions but do not verify goods, services, businesses, job openings, or property, and do not vouch for anyone you deal with. Transactions are between members. NAKA is not a party to them and is not responsible for what happens.

8. Advertising

Sponsored placements are governed by our ad policy. Payment is authorised at submission and only charged once an ad is approved, so a rejected ad is never charged. Ads removed for breaching the policy are not refunded. Approval is not endorsement. Full terms are presented at submission.

9. Community Notices

Community Notices exist so families can reach members at difficult times. NAKA does not collect, hold, or administer any funds in connection with a notice. Where a notice links to a family's own contribution channel, that is between you and them, and we do not verify it. Posting a notice that is not genuine, or using one to solicit for an unrelated cause, will result in removal from the platform.

10. Governance

Members in good standing may stand for and vote in elections, subject to the bylaws — including being in good standing as of the record date. The bylaws govern where these Terms and the bylaws differ on association governance.

11. Ending your membership

  • You can delete your account at any time from your profile. See the Privacy Policy for what happens to your data and content.
  • We may suspend or terminate an account for breaching these Terms or the Community Guidelines, or where required by law. Serious breaches — threats, fraud, exposing someone's immigration status, scraping the directory — may mean immediate termination.
  • Dues already paid are not refunded on termination for breach.

12. No warranty, and limits on liability

The platform is provided as is. We work to keep it available and accurate but do not guarantee it will be uninterrupted or error-free.

To the fullest extent the law allows, NAKA, its board, officers, and volunteers are not liable for indirect or consequential loss, or for loss arising from your dealings with other members or with businesses found through the platform. Our total liability to you is limited to the dues you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify NAKA against claims arising from your content, your use of the platform, or your breach of these Terms.

14. Changes

We may update these Terms. Material changes will be notified by email or in the app at least thirty days before they take effect. Continuing to use the platform after that means you accept them.

15. Governing law

These Terms are governed by the laws of Virginia. Disputes are subject to the courts of the Commonwealth of Virginia, United States.
